Refund of donation amount

Can student also claim refund of donation amount along with admission fees from educational institte through court of law, paid at the time of seeking admission.

Donation in what form? As pre condition of admission (probably this is prohibited)or normal donation. Have you got the receipt of donation. if so can you satisfy the court that this was for admission and not otherwise. If this is normal donation to an educational institution without proof of any direct link to admission, I doubt it can be claimed back.

Donation is assumed as voluntary gift without expecting return back of that. However, if you want that back you must be able to prove in the court of law that you were compelled to make the amount as donation against your wishes by the management of the educational institute.

Experts are right.
But in practice hardly any admission seeker make them voluntarily all they receive under
undue influence but proof may be a little tough affair in court of law.

Prabhakar ji,

In fact education has become a trade and business. Every one knows that the donations are taken forcibly from the parents of the students, but none comes forward to check such type of irregularities on the part of the management of such educational institutes. I wonder, even if receipts would have been granted by the collectors of such donations in many cases.

So, it is not little tough, but quite a tough job to gather proof of such illegal trade of donations and to prove in the court of law.

School admit students in Primary with Donation/ Refundable Deposit for building construction for School.
Even if they return after 10 years when student leave the school, its value vanished..

Education had become safe and prestigious business now a days.

A FACT:

One builder could not sell his grd floor 10 flats, due to recession before 12 years.
He had affairs with a teacher, who suggested to start school in those residential Flat, as money were blocked.

He agreed, and collected Donation of Rs. 2000/- per child, and could get double the Flat costs, and started contineous income every month.
a uneducated man became "Siksshan Samrat" , and now he have chain of Schools and colleges. Owned by him, his wife, his son, his son in law, and have Empire of Educational institution all over nearby Mumbai.

Her gf also was presented with building with School. All Happy.
Ministers comes to celebrate /inaguratons and now he is one of the richest/ highly influential person.

An another politician was not taking any donation for 2 decades in admitting students for Engg degree.
He lost Election last time.

So in anger, he collected 5L & above donation & all seats are booked, till date for last 6 years, became multi cr.
