Hi to All,
I just wanted to know who is eligible for the property owned by my father.
I belong to warangal district in Andhra Pradesh, the property is earned by Father, we are 3 brothers and 1 sister. My father want to give share to his sons but my sister is also asking for the share. Just wanted to know, legally is she eligible for the share in the property. My parents are alive. We all got married- my elder brother has 1 son and 1 daughter, my second brother is a govt employee and has 2 sons, I have a daughter and my sister has 2 sons. please tell is my sister is also eligible for the share in the property. Thanks

if its father's self acquired/ earned property then he can partition the same as per her own wish.
During the life time of the father, the children cannot compel the father to partition the property in a particular manner.
Since your father is alive so your sister cannot compel your father to give her a share from his self acquired property.

EVEN IF FATHER IS DEAD, SISTER CANNOT DEMAND PARTITION, Unless Brothers are Willing to Partition, in Dwelling house.

Sir,
If You are hindu,and your father accured the property by himself in his life time and he is alive now.Then no one can claim or initiate partition.More over your father can do on his wish.But if your father left with out any will or settlement then your sister can claim share of his father.

Question of right or eligibility of sons and daughters to property of the father does not arise during the life time of your father.

If my mother is also willing to give the share to my sister...however, the property is completely earned by father itself. Now as mother is also on m y sister's side, is my sister is legally eligible for the share in the property as my mother is supporting her, wherein my mother has not earned any property and only my father has earned the whole property..
Please help me....Thanks

only your father can decide whom he wants to give the property . since it is self acquired property of father he can gift it or bequeath by will to whom sever he decides . your susiter would get a right only if your father dires without leaving a will

Your father can dispose of property in whatever manner he decides during his life time. Question of eligibility and right of heirs would arise only after his death.

Your father has self acquired the properties in question hence he is absolute owner and can dispose off them in favor of any person of his choice and none of his children,male or female can raise objection to his choice.
