Hi All, A contractor of furniture has completed his assignment and only half of the contractual amount is paid, the company is not paying the rest of the amount. Where can a contractor can file a suit for his payment dues ? Does a contractor comes under the purview of labour laws ? or he can file a money recovery suit in the civil court ?

First send a legal demand notice to co.and demand from co. the balance payment and ask co. to pay the said payment to you in 7 days time, with interest @18% p.a.

through the lawyer you send legal notice state all facts of contract and ask to pay the due with in stipulated time, if not initiate the action

whether the contract is in writing, then furnish notice as per other expert advised otherwise u should issue invoice for executed work and if the payment revived by cheque the n ask for balance through notice etc.

whether it was a turn key contract or it was only a labour contract (where the master supplies the raw materail and contractor arranges labour). If it was labour contract then the contractor is not protected by labour laws but his workers are protected and they can proceed against contractor as well as company.
