My father was expired due to health problems while working in LIC. I have a brother. He has a job in a private company and gets a salary of Rs.24,000. I am the daughter of the deceased and applied for the post. But the manager rejected my claim to the post on the ground that my brother had a job.
Can I challenge this denial of my application?
How can I get this job?

Appointment on compassionate grounds is to see that the dependents are not thrown to streets. Your brother being the member of family has got to maintain you all. The manager is right in rejecting your claim. Appointment on compassionate grounds is not a right.

Appointment in dying in harness is meant for providing immediate relief to the family, whose bread earned is died. If the family is financial sound or have any other source to support, the employer is right in rejecting the claim. It is extra ordinary source of recruitment and are available to the family of the deceased employee under certain circumstances. It can not be claimed as matter of right. In the present case, if you can show that your family has no other source and your earning brother is staying apart from family, you can get employment. Thus take a chance and file a writ in High Court.

LIC is a central Govt Company and is expected to follow Central Govt norms which are as under :-
Such jobs are given only out of 5% of Class III&IV posts (in direct recruitment quota) and comparative merit of the applicants is assessed. Remember reservation beyond 50% is not allowed as per Supreme Court guidelines. The Govt sector jobs are already reserved to the extent of 50% (15 SC+ 27 OBC + 7 ST). Therefore even that 5% is to be taken from the proportionately by vertical reservation from the respective share of Sc/ST/OBC/gen category posts depending upon the category of the applicant. That being the case the share if gen candidate is 5% of 50% = 2.5% out of total Class III&IV posts (in direct recruitment quota) , and OBC it is 5% of 27% = 1.25% out of total Class III&IV posts (in direct recruitment quota) , for SC 5% of 15% = .75% out of total Class III&IV posts (in direct recruitment quota) , and for ST it will be 5% of 7.5% = 38% out of total Class III&IV posts. No job can be offered beyond that limit even if the applicants are large number. The slots reserved for Handicapped, ex-servicemen and sports persons are also allocated in the same manner to ensure that horizontal reservation does not exceed 50%. So comparative merit is drawn based on the indignant condition of each family
Such jobs can be allowed/rejected by the appointing authority based on deliberation of a board. I do not think that Manager will be having jurisdiction to decide on his own (unless he has communicated the decision of competent authority).
Your representation can lie to the Chairman. In any case your claims appears not a very strong one.
Your query is silent on the date of death. You may have no claim if the claim is made unduly delayed after death.
Further even if you are considered and found eligible it is not necessary that there may be a desk job as the appointment in this case depends upon the available vacant post.

LIC has its own appointment of dying in harness rules. But basic principle of appointment in Dying in harness are same.

I support the views of Sudhir supported with legal provisions prevalent in LIC. There is no scope in the given case to have compassionate job. You can utilize other death cum retiral benefits to be awarded by corporation for your betterment.

make an appeal to the chairmain LIC and also seek the help of their unions too.
sometime it may help.
also meet the P&IR dept of the concerned LIC Divisional Office for further guidance.
Manager has no discretionary power in thgis.

Appointment on mercy ground is for one person only to avoid starvation of employee's family. They prefer wife, if educated, or can be accommodated.
Failing which, eldest son.
After your marriage, your husband is bound to maintain you. You are not bound to maintain your brother , or any family members.
Your brother is bound to maintain your mother, if exist.
Nothing wrong trying it, though chances are rare.
