Mobile records

Querist : Anonymous (Querist) 18 January 2012 This query is : Resolved
Sir i am fighting a divorce case and i want to know that

1. can someone with the help of a police officer(as personal friend) get my mobile phone call records.

2. if yes then can he also hear the conversations made between me and another party..meaning do the cell phone service providers record our conversations and can they provide them to these people. the conversation referred to is almost 30days old.

3. can sms's exchanged also be read?

I would like to specify that no FIR/Complaint is ever registered.
Kindly help at the earliest
regards,

1. Yes
2. No as it does not remain recorded unless it is instructed by Police or court earlier.
3.Yes

Then Police may not intervene unless some crime is committed.
But nothing there to loose heart as during evidence you can summon the Mobile Company officials to bring necessary details as stated above.

Well Advised as there is no reason to differ.

1. yes, your cell phone records can be accessed with the help of police department.

2. Conversations are not recorded in default. That needs prior instructions/directions from police or court.

3. SMS exchanged can be read.

FIR not registered now does not mean that no FIR will be registered in future.

But you told in the query regarding a police as a personal friend. Do you think in such cases FIR is required for such actions??

dear sir's,
thank you for your kind advice but pls tell me how long do these mobile companies retain the sms exchanged record..and can any police man unofficially using his position go thru them. im relieved to hear that no conversations are recorded unless given prior instructions.

DO NOT WORRY.
Police not concern in family matter, will not use their power to get details from service provider in your case.

Advocate. Arunagiri (Expert) 19 January 2012
Without proper official communication from the police department, the mobile operators will not provide the call records.
