Will

Querist : Anonymous (Querist) 26 December 2011 This query is : Resolved
My grandfather has written the registered will in the name of my Father. My father has one sister who is alreday expired. The property is still is in Grandfather name. Now can my father can write a will in my name without trasfering the propert in my father name. Is that will be valid will. After my father on the propert there will be two will one by my grand father in name of my father and from my father to me. It is ok as per law. Or there is some other beter way of doing this.

the will effected after death of testator, so until the owner of the property having full rights, so no one transfer until.

Thanks for Reply M Sheik :

You are right no one can transfer untill testator is alive.

I have a question that first property owner died with registered will and then the person for whom will is made can do will for the same property to his son without tranfering the property in his name.

Has your grand father died?
If yes then your father has become the beneficiary of that Will and the owner pf those property.
Legally he can well execute a Will in your favour even if the property has not been mutated in his name.
However do take a Probate of the Will which your grandfather has executed in favour of your father.

Yes my grand father died and we have not done the mutation of property in my father's name. Please let me know the meaning of "do take a Probate of the Will which your grandfather has executed in favour of your father".

Please send me the simple will form also

probate means judicial proof that will is valid . on death of your grandfather you ought to have taken probate and got property trasferred in your father name .

no ready made format of will . depends upon facts of case
