Petition u/s 156(3) taking 6 months

Ld advocates,

Magistrate is taking more than 6 months to pass orders on petition filed u/s 156(3). Is it normal. What can be expected. Police refused to register a case, I have attached the copy of the complaint the closure report filed by police claiming that complaint is not reliable.

The complaint is a counter complaint regading marriage dispute.

Please clarify.

I filed a 156[3] 2 years back and magistrate for 1 year kept it pending and after orders from HC for speedy disposal it came to an end.

So my advice to you is get orders from HC for a speedy disposal of the 156[3] application.

I am not sure about what you people are talking about as in WB the Magistrate on the very same day pass the order.

It depends upon person to person. There is no hard and fast rule to send the complaint on the same day before the concerned police.

The moot point here is that it is a counter complaint against a case registered by your spouse (Almost sure it is your wife), hence the delay.

You can puruse the case u/s 200. That might turn out to be faster.
