Let him deposit the amount in the court. No need to issue legal notice.

IBRAHIMPUR, TALLA, P.S. BARAUNI, DIST- BEGUSARAI …… PETITIONER
Versus
THE STATE OF BIHAR ….. O.P
-----------
2. 28.8.2009 Heard learned Counsel for the petitioner and the
State.
The petitioner seeks bail in a case instituted for
the offence under Sections 498A and 494 of the Indian
Penal Code.
Taking into consideration the fact that earlier in
pursuance to a compromise arrived at between the parties,
the petitioner was to deposit Rs.40,000/- in favour of his wife
Laxmi Devi which he was ready to do, however the lady
never turned up to take the said money, due to which
strangely enough the petitioner’s bail has been refused by
the court below, let the petitioner above named, who is in
custody since 22.5.2009, be released on bail on furnishing
bail bond of Rs.5,000/- (Five thousand) with two sureties of
the like amount each to the satisfaction of C.J.M., Begusarai
in connection with Complaint Case No.1151C of 2007 on
condition that Rs.40,000/- as Demand Draft will be
deposited in the court below which the complainant will be
free to withdraw. To enable the petitioner to deposit the
Demand Draft, he will be initially released on provisional bail
for two months which will be confirmed on its deposit
