Dear experts, kindly review your opinions. What says section 437 cr.p.c? When any person accused of, or suspected of, the commission of any non-bailable offence is arrested or detained without warrant by an officer in charge of a police station or appears or is brought before a court, he may be released on bail. I think this only the section is says..

Its mean expert mr.barman's stating section is correct. But the illustration is wrong. I mean how can the accused surrender him self while he is already in judicial custody.

And with in my little knowledge high court or court of sessions only can be given direction to surrender before concern court, and consider his bail application on the same day. Unless.. the accused can't be surrender him self and can't prays to release on bail.
