My wife filed divorce petition in family court under section 13 1(i-a & i-b) of Hindu Marriage Act.

My Query:-
1) Can i file visiting rights application for my minor son in said divorce petition.

Yes, u/s 26 of HMA you can apply for visitation rights along with temporary custody of the child.

You may try filing an application u/s 26 HMA, however courts generally don't grant immediate reliefs in the said application.

It is better to file a different suit for visitation under GWA.
