Respected Sir,
I am a disabled person. My parents were lured by my younger brother and he tries to grab my parent’s whole property. Now, my father is ready to register the house to my brother and evict me from the house. After my grandparent's death, my father and his brothers valuated the grandparent's house and they got money from their last brother and handed over the house writing a deed to their last brother which has not been registered yet and they have been enjoying the property. My father and his brothers partitioned my grandparent's house and agricultural land when my grandparents were alive before 18-years. From the resources of the above my father contributed some part of money and we also contributed some money including my grandmother to build this house jointly in the Lease Land. But my father has been paying House Tax for this house for the past 20-years being a family head. Relying on my father, I have given more money to my father whenever he needed money for the sake of this built house. My younger brother asked my father to renovate the house. Accordingly my father started renovating the house. When I tried to contribute some amount for renovation, they refused to get the money from me. Because my mother wants to register the house to my younger brother having more love when this lease land becomes Patta(registered)land. My mother always troubling and forcing that this property is self acquired property of my father. And also my mother's name (Ladies Name) has been proposed for registration (Patta) of this house by Tamilnadu government. Once the registration of the house is done in the name of my mother, my mother will definitely "gift" or execute the "Will" in the name of my brother,no doubt in that. Now my father is also not ready to give any property viz, both my father's or my grandparent's property and they tried to evict me and my family from the house. How can I protect from the 'Will' or 'Gifts' or 'sale of property' execution to my brother as a precautionary measures. What are the steps to be followed to avoid the execution of the house to my brother by my parents? My brother disagrees to get equal share from this house now and even after my parent’s death also. Please help me protect this monopoly execution of the house built in Lease Land (ie, in Government Land). Awaiting your valuable suggestion please.
