pay order wrongly delivered to a person with same name. he deposit and now denying to return amount. what legal action can be taken to recover the amount? pls advise

Ask the civil suit for recovery. You can file criminal case of impersonation with cheating as well.

File criminal case of impersonation and cheating.

File a criminal case under section 419 and 420 IPC against him instead of filing recovery suit.
