my client filed a suit for eviction under sec 106 of tp act. he became seriously ill when the matter came up for trial his wife deposed on his behalf. how will the court view her statement

Her testimony will surely be considered if she has direct knowledge to the dispute raised in the suit.

if wife is also a party to suit only then her

testimony has any value in evidence and

otherwise it has no value in case.

Court has to consider entire evidence submitted by both parties and the evidence of the wife of the plaintiff cannot be set aside if she has deposed about the illness of her husband in her evidence in chief.
