Laywer not attended case

(Querist) 17 May 2012 This query is : Resolved 
I have paid a huge amount to a lawyer to fight my case. He didnt appear before the court on the date of eharing and the stay was vacated. He has not even attached the documents for which he assured me he will attach to case.
After the stay was vacated he said go to Supreme Court
How can I get my hard earned money back.
Can I file a case under 420 against him.

how did you make payment?

was it by cash or cheque?

was any receipt given by lawyer?


was it mentioned that fees shall be for arguing stay application ?


if he has not appeared before court inspite of taking fees he is guilty of professional misconduct . complain to bar council

Non payment of fee or payment of fee doesn't matter. Where as the lawyer has filed his vakalath he is bound to represent his client even client has not paid fee. Criminal case as 420 etc can not be filed. You can approach to the concerned bar council with your grievance against your lawyer, or you can file a complaint before consumer forum.

Unless you can bring evidence that advocate did not attend the court which will be on the record of the Judgement, your complaint has no base.

Just because the stay is vacated is not the fault of the advocate.You can go in appeal.

Does the order vacating stay speaks it self that stay was vacated due to his non appearance?
