Mutual divorce petition

(Querist) 14 September 2011 This query is : Resolved
Hi,

Can somebody let me know the procedure of making a payment/compensation amount to a girl while taking a mutual consent divorce, as I doubt about her and her family members genuiness? How the payment should be made so that I would not be in trouble in future?

They are asking for initial payment. Which I'm agreeing and rest payment in second motion. What procdure should be followed to safeguard my money so that she will not deny the payment in future?

Thanks & Regards,

Whatever you incorporate in the petition for mutual divorce, the wife after divorce can again go to court and ask for maintenance provided she is not married and does not have good source of earning.

Some amount of agreed permanent aliemoni may be made at the time of first motion and rest at final. There is no substitute of mutual faith, however, third person common for both can also be involved in this process or an amount and its process to pay may also be mentioned in the petition itself.
