Can a co - owner of an undivided property file an eviction suit against a tenant on the grounds of default of payment of rent, even if other co-owners do not give consent to the suit against the tenant ? The jurisdiction is West Bengal, India.
In West Bengal, India, a co-owner of an undivided property can indeed file an eviction suit against a tenant for non-payment of rent. This action can be taken independently, without the explicit consent or involvement of other co-owners. The co-owner has the right to issue an eviction notice and proceed with legal action based on valid grounds like rental default.
