We have a commercial property at jogeshwari (Bombay)leased by my great grand mother and we have obtained the probate of the will,our tenants are paying us the monthly rent.We wish to evict them on the ground of bonafide requirement.we have the zerox copy of the lease agreement which has expired in 90s.Kindly help
One tenant has sub letted the premises to some one else but he's dealing with him in cash so we cannot prove it.On the other side he has not taken shop establishment license ,trade license and factory permit from BMC,can this be useful in court ?

If the requirement of the premises is for bonafide requirement, you can file a suit for eviction.

If you can prove that the premises is needed for your personal use, you can get the eviction order.

That the premises are required for Land lord's own use is one of the grounds approved under Cl (g) of sub sec (1) of Sec 16 of the Maharashtra Rent Act, 1999. The section also provides for several other grounds on which a LL can demand possession of the leased premises from the tenant. Hence issue notice to the tenant for possession of the premises on one or more grounds under Sec 16 of the Act for which u have sufficient evidence to be produced before the Court.
