Employment as well as part time business

(Querist) 19 April 2011 This query is : Resolved
Can I continue my employment in one organisation and open a part time business?
Are there any legal complications?

Dear Kalpana,

If you are in Government service or in service of a Government owned company or corporation, it will definitely be a misconduct on your part to do any business (full time or part time) and your organization can take disciplinary action according to the Conduct and Discipline Rules of the organization.

However, if you are in any private organization, that depends only on the provisions made in respective organization's Employee Manual or the Conduct and Discipline Rules, or the Model Standing Instructions, as the case may be. So, you may have to go through the concerned Rule Book to find a proper answer to your question.

better ask from yr appointing authority for it,
because what ever is not permeted is prohibited!

No illegality, as long as the employer does not object it. The business should not be a competitive business or against the interest of your employer.

It all depends on the service contract that you hve entered into with your employer.
In simple words, if your employer does not object, you can run.

Unless you get a written permission from your employer, even if it is private organisation, it is not advisable not to venture, for any part time work.
