I had filed a case for divorce in ghaziabad,UP in NOV 2009. It is goig to be an ex parte in a month. My ex had filed 498A and DV in gurgaon, Haryana in SEPT 2011. Needless to say it was for harassment as she has everything of mine and is very rich and politically powerful.
I want to know if i can take advantage of this Ex Parte in my 498 and DV cases?
Also, in worst case scenario what is the punishment court can give? as i dont even have money left to hire a lawyer and have been to 9 days of total Police and Judicial custody...so doesnt matter.

USUALLY 498 IS 98% FALSE PROVED, SO ACQUITTAL.
By the time of proceeding, u will know how to proceed, and can become expert in, how to win it, so don't worry.

If you cannot hire lawyer dur to your low income then you can be provided free legal aid. Move an application before the same trial court at Gurgaon and have this facility on the same day.
Nothing can be predicted without having facts and evidence before us, however, your divorce petition shall definitely provide benefit to you.

you will be lucky to get diovrce shortly . had your wife contested the case it would have taken years .
after you obtain divorce then follow the advise of mr makkad and obtain free legal aid

Ex-parte decree won't help you directly in 498a and DV.
Start attending SIFF meetings in Patiala House Court Complex, every saturday between 4PM - 7PM.
Also, get free legal aid lawyer/ learn some basics of law yourself.

In my views, ex-parte divorce in 2009 case may help you much in the 498a case of 2011, as can well be considered as an after thought on the part of your ex and a matter of revenge also.
