(Querist) 23 January 2012 This query is : Resolved
We work in public field and try to help who can not help themselves.

We have a current problem.

A son has taken POA from his mother and managing multi million property.Mother has no knowledge of goings on since semi literate housewife.

Father is no more and son and his siblings are keeping the mother worst than a maid servant.

Any action possible under DV act by outsider.

I don't think, Mother will lodge Complaint against her son.
First confirm it, or all affords will be in vain.

Only the aggrieved person can lodge complaint under DV Act.

Then mother in this case can do so, not you.
However you may lodge complaint with police.
Another relief is under Senior Citizens Act and Women Grievance Cell.

Mother in the given case have various rights. she can cancel her GPA. She can claim maintenance. she can file civil suit for return of her estate. She can file criminal suit under section 406/409 IPC.

But question is who shall guide such mother and who shall persue her case.

Any action possible under DV act by outsider.?????
A plain no is the answer.
However action is possible by outsider under following provisions of section 5(b) of THE MAINTENANCE AND WELFARE OF PARENTS AND SENIOR CITIZENS ACT, 2007 which reads as follows"5. Application for maintenance : (1) An application for maintenance under section 4, may
be made—
(a) by a senior citizen or a parent, as the case may be; or
(b) if he is incapable, by any other person or organisation authorised by him; or....................................."

HOWEVER IT IS ALSO ADVISABLE THAT MOTHER REVOKES THE POWER OF ATTORNEY IN QUESTION.
