Do minors in muslim law have share in grand fathers property

Hi sr/madam,

We have bought a land from a widow women, whose husband and grand father in law expiered at that time.

Widow women and her 6 children signed registration deed in 1995 , now her minor children filed a suit in 2005 tht they have right in that property.

Please help us to win this suit

Normally right is there but the suit is apparently barred b limitation.

when they attained majority?

When sale deed made in 1995 one minor was 17 years another one is 11 years and they filled case in 2005. Means in 1996 one attained majority. Another one got majority in 2001

As my local lawyer told limitation act is 12 years. Since it is muslim unmovable property. Ur response i great full for us

No doubt limitation is a vital issue but minor have have their right in the property but you have to prove that minor guardian although not acquired right to sell minors's right at property but they sell it for the benefit of minor and obtained consideration of property at market rate along with the minor rights

Minors were having right. Prove that property was sold for the benefit of the minors.

As per sale deed they have mention that they are selling the property for house maintaince and business purposes.

Hi,
In civil court we lost the case saying mother is not a natural Guardian so minors got the share in property.
Kindly help us any way to win the case
