Divorce & rights of wife

(Querist) 06 November 2015 This query is : Resolved
What is the maximum demand a wife can make from the husband during a divorce, as per law, where children are adults. My query is regarding maintenance, share in husband's self earned properties, etc.
Devajyoti Barman (Expert) 06 November 2015
There is no such upper limit. The wife is however entitled to 1/3 to 1/5 income of husband as her monthly maintenance.
She has however no share in the property of her husband.

We were staying in hyderabad since our marriage in 1987. She, on the influence of her parents, has left my house in Feb 2012 along with adult son & daughter. Her plan was to demand money from me & stay separately with her parents in kolkata. As she couldn't implement her plan immediately, she made false publicity first that I was not treating her & children properly. Then she realised that if disturbance starts, daughter's marriage would be a problem. So she temporarily put aside her plans & reconciled with me. Then we saw a good match for my daughter & got her married in Jan 2015. Now she got back to her plan & did not return to hyderabad. She wanted me to file divorce so that she could demand money from me. I filed divorce in hyderabad & she is avoiding notice / court summons & putting her abnormal demands through her relatives. Somebody advised her that court will not give divorce till notice is received by her. After she recives notice & does not attend court, only then it is possible. So she is confident that divorce is not possible and she can get her demands accepted.
Please advise what I should do in such a situation.
