Divorce

Sir,
Thank you for your valuable advice.A person wants to give divorce to his wife, can he be asked whether he wants to live with his wife or his girlfriend and if he says he wants to live with his GF, will Hon. Court permit him to do so, without his wife's consent and if she objects, what will be the cause of action?

During subsisting of first marriage,he may be charged with criminal offence u/sec.497 IPC for adultery as well bigamy under respective Marriage Act.

Neither Courts asks any person as you narrated nor such person is permitted to live with his GF during the subsistence of his first marriage. Try for mutual consent divorce, if you both have reached to such situation.
