Divorce

Sir,
I m a 34 years guy got registered marriage in 2006. But have not started cohabitation till now. Due to some extreme conditions, I have applied for contested divorce against my wife on desertion ground on 14.05.2012. The family court has given me the copy of notice for sending to my wife's address. The date of court attendance is fixed as 18.06.2012. Now, I want to ask you, what will be the perfect time for sending the registered post to my wife's address? I want she does not come to the court and an ex parte decission issued by the court. I have to win the case anyhow, sir. Please help me. I m in a great distress. I just cannot tolerate that wife.

You can only seek to serve her, whether she comes or not or in other words - whether it is ex parte or not - depends on her recieving the summons. What you are seeking to know is not legitimate practise, and not at all advisable.

You have mistake to file a Divorce suit,your suit is concerned to file a petition for annulment of marriage for nullity as your marriage was not consummated and there is no question of alimony.Since you have admitted your cohabitation by filing a divorce suit and also taken burden of alimony.You should send notice immediately to your wife,ex-parte depends on your wife's absence in the suit.

At any time within the date of adjournment you will have to send the summons and the service of summons should be reached within the next date of adjournment. You cannot restrict her, it is left to her to appear in the case or not. If she appeared and contested the case, you will have to defend your case. If she didn't appear then no problem.
