Expulsion as member of housing society

(Querist) 26 October 2016 This query is : Resolved
I am regularly paying maintenance and other charges required for emergency maintenance of society but since Jan 2016 they are levying fine of rs 2000 per month for keeping tulsi pots in box grill. I had asked them many times to give reason of why they are going against AGM rule but they are not replying to letters. Now they are verbally threatening me of expulsion as member of society and asking to pay the fine accumulated.

Under what circumstances they can cancel my membership? I am in a complete mental distress. Please help.

Non convincing. Seems to be an academic query.

Anyway, if the act of the MC is against the byelaws of the society, you can challenge their decision in the court of Registrar of Societies.

1. EVEN "IF" expelled from Society Membership, In a "Tenant-Ownership" type Housing Society, where the member is the "Title-Owner" under the Transfer of Property Act, the Flat-Owner can continue to exercise all rights /possession of a Flat-Owner, without any reference to the Society, BUT to the exception of participating in the Society Administrative affairs, voting, proposing, seconding and attending General Body meetings.

2. Personally I would prefer to suo-moto resign from the membership of such nefarious Society and continue staying in my Title-Ownership Flat, without any hindrance from the Society.

3. WHY bother for membership ? ? ? ?

4. Such Society membership are for the NERDS, who prefer to live in ghettos.

Keep Smiling .... Hemant Agarwal
