Delay in construction of commercial project

(Querist) 22 February 2018 This query is : Open
I had booked an office space for my own use in a commercial project in NOIDA in Nov 2012 thinking that I would do some consultancy post my retirement. I have paid 60% of the cost but construction has not reached even first floor.

I have now filed a complaint in RERA. I would like to know if filing a complaint in RERA is beneficial as compared to consumer forum or NCDRC.

Which forum is fast in resolution.

Thanks

Sir,

If its commercial then its no use to file in Consumer Forum....

RERA is best available option as far the district consumer forum is concerned that will take long period of time as there are various other matters being filled other than the one relating to immovable properties.
Its wrong to state the district consumer forum will not entertain the matter relating to commercial property as I had for my own commercial property moved the New Delhi District Consumer Forum many years back and got suitable financial relief after fighting for 2 years, when there was no RERA available.
But as stated above go ahead with RERA for earliest relief.

RERA is the forum. GO thru RERA rules framed in your state.
NCDRC is also a forum where affected consumers can approach by class suit also.
I am sending you a few links and you may pick up relevant points and share with others also to spread awareness on RERA and Class suits.

Go to RERA
You may also move Civil Court/ criminal action.

The Consumer Protection Act, 1986

Section 2 Definitions. — (d) “consumer” means any person who,—

(ii) 12 [hires or avails of] any services for a consideration which has been paid or promised or partly paid and partly promised, or under any system of deferred payment and includes any beneficiary of such services other than the person who 12 [hires or avails of] the services for consideration paid or promised, or partly paid and partly promised, or under any system of deferred payment, when such services are availed of with the approval of the first mentioned person 13 [but does not include a person who avails of such services for any commercial purpose];

your problem falls under commercial dispute and not entitled to claim benefit under consumer Protection Act
