2.To succeed in defamation suit,what is to be proved?

3.How to find out past decided cases on Defamation?

Dear Friends,

This is not a case for academic interest.
A case has been filed by a firm of Auditor
of public limited companies for writing and exposing the internal problems of the firm to the Board of Directors of the Companies in which the firm is auditor.

First the partners went to the police station and filed complain for extortion and blackmailing. On my reply in writing
the police closed the matter.

Now the partners of the firm of auditor has filed a defamation case in the Bombay High Court on original civil side.

A motion to the suit was moved by the advocate of the firm and ex-parte interim order was passed by the Hon.High Court putting some restriction on me.

I wanted to know what is the difference between the MOTION and SUIT.

What should I do now?
Is there time limit to reply to such order?
What is the time limit to file statement to the suit?
How can I find past cases for reference?
Is there any text book on defamation or
any text book useful to me?

Please advise me.

notice of motion is application for interim reliefs in the main suit . you should engage a lawyer .

you should file written staement or reply at the earlist in the high court preferably within period of 30 days from date of service .
