Defamation

I have been defamed in a very determined and hostile manner, with defamatory statement said to me to my face, as well as distributed over the internet through emails. I do not have copies of these emails, though I have been received calls indicating presence of such emails. I have experienced painful avoidance by former friends and general hostility by those who have heard the defamatory statements.

As a result of this, I suffered major depression and am under medication to deal with the effect of social boycott. I know the main actors of the malicious talk. Is there any thing I can do? I had avoided taking action (not informing my office, for example) for reason of keeping away negative publicity. I have been threatened with dire consequences if I proceeded with any legal action.

Can someone please help.

How you will prove your case before court of law? You got mails.. But you don't have the copy of that mail's thread.. You got defame by phone call.. How a phone call conversation can be treat as defame?

Dear author, kindly see the section 499 of i.p.c. There you can find the explaination for defamation. '' whoever, by words either spoken or intended to be read or by signs or by visible representations, makes or publishes any imputation concerning any person intending to harm, or knowing or having reason to believe that such imputation will harm, the reputation of pubic person, is said except in the cases hereinafter excepted, ve defame that person''. So any conversation between yours without knowledge to others can't be treat as defamation.

Atleast some of those who recd emails would be ready to stand with you.

collect those evidences, only then a case under defamation is possible to stand in court of law.

First of all ask people, who have talked to you about existence of such mails, to forward copy of the mail for your examination and response. Examine the contents and come forward with the real problem instead of hitting in the dark.

First of all you shall have to proof that there is a defamatory statement against you.
Secondly, you shall have to proof that such defamatory statement lowered down your prestige in the eyes of the people in your society. Thirdly that such statement sufficiently caused injury to you.
