(Querist) 03 July 2010 This query is : Resolved
Whethere a criminal case against presentor of sale deed on behalf of company is maintainable or not? Particularly in that case when authorised signatories on behalf company are different person.
adv. rajeev ( rajoo ) (Expert) 03 July 2010
In my opinion company and the managing director along with the presenters of sale deed will be held responsible.
Raj Kumar Makkad (Expert) 03 July 2010
Criminal offences are committed by individuals so if presenter has committed any offence though he may be authorized signatory of a company, is liable to be prosecuted under law of land in his personal capacity.
Devajyoti Barman (Expert) 03 July 2010
The presenter if signed the deed can definitely be prosecuted if the charges relates only to the forgery or fraud of that document.
Uma Shankar (Querist) 03 July 2010
Dear All, In this case the presentor has just presented the documents before the Sub Registrar Office for registration only. He has no role as a authorised signatory. Authorised signatory are different persons. Charges are not related to the forgery or fraud of the documents, charges are just cheating by company.
