Court summons issued by my previous employer.

Hi
My name is Nirup and I am a former employee of HSBC bank in Bangalore in corporate sector. I went absconding from my job since I had to take care of my mother who is suffering from paranoid schizophrenia. After a few days of leaving my job I got a notice from my employer to pay certain amount due. However, I chose to ignore it as I wasn't paid anything apart from the time I have worked. Now though I have a court summon issued against me, I believe it is under section 61 as it says at the top of the form. How do I proceed further. Im going through a financial crisis due to which Im not able enough to hire a lawyer or pay the requested amount. Any advice on this matter will be helpful.

you have to contest the case as you are unable to pay your employer and further as per you NOTHING IS DUE. so contest the case, if you are really not in position to make payment to lawyer you can approach District Legal Services Authority of your district and they will provide you services of lawyer free of cost.

What is this amount and pertaining to what?

Did you employer issue any appointment letter to you and is this amount as per service rules/conditions?

Why did you have to abscond if your mother was sick?
You could apply for leave?

Did you apply for leave? Do you have copy and POD?

Was this leave rejected? Do you have copy of rejection?

How many persons report to you?
Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?
You are in which state? Since how many months you are working?

Was ever any stinker, memo, show cause notice on any misconduct issued to you?
Are you a member of employee’s/trade unions?

Engage a prudent local lawyer and contest the case if you are unable to reconcile and persuade your employer to withdraw the notice/case.

which claim they are asking for, actually details for the claim from your employer is not given by you. anyways you check with them and try to setele the issue.
