Defamation, malice and punitive damages

(Querist) 11 December 2013 This query is : Resolved
Dear,

If some one files a false FIR by giving wrong information to the police, what are all the legal remedies available for the falsely accused person?

How can the accused person file defamatory suit against the complainant?

Is there a possibility of getting punitive damage or exemplary damage for malicious intent in our country?

Incomplete facts, engage a local lawyer for filing case of (civil or criminal) defamation.

Yes a libel case both in criminal law and civil law is possible but the burden of proof lies on the complainant for defamation case, mere acquittal in the FIR case will not entail him to file such cases.
