I bought two non judicial stamp papers from a licensed stamp vendor in tamilnadu in good faith with the name of the purchaser, serial numbers which were consecutive serial numbers on the same date written in his own hand along with the signature of the vendor and the seal in good faith and used the same for executing a sale agreement. But the vendor has recorded the sale entry in his sale register and therefore it is being said that the sale agreement is invalid.
what is your opinion? The Licensed stamp vendor either sold fake stamp papers or he failed to record the sale transaction in his sale register.
When the stamp papers are bought in good faith can the sale agreement be declared invalid?
Please give some citations of court judgements on the same.

It is not the duty of the stamp vendor to record the sale entry in his records. He shall enter the name of the person who purchased the stamp and the name of the person for whom he purchased it, the value of each stamp and the total value. But other things need not be written in his stamp vendor registers. He did not violate the rules, as per your statement.

It is not invalid.
If the vendor says it is not valid it means he is not willing to sell the property

is there any court judgement that safe guards the validity of the document executed in the fake stamp paper supplied by the Licensed Stamp Vendors during telgi scam period

You are deviating from your main subject, if you suspect the stamp paper to be fake then you can give a complaint to police for taking necessary legal action or if you want to have some judgement you can search for it on the basis of your requirement through internet or if you are just passing time through such questions then you may not be able to get any more opinion from experts here.

Thank you very much Kalai Selvan Sir for your reply to the query that I had raised in this professional forum.
But I fail to understand why you got the impression that I am *passing time through such questions* when the fact remains that I had bought the two non judicial stamp paper from the licence vendor way back in 1998.
To my understanding, as per the stamp rules in Tamilnadu the licensed vendors are supposed to maintain sales register which they are supposed to submit to their higher authorities for audit and reconciliation of the accounts.
But what has really happened is, during the years 1998 to 2003 many licence to vendors across the country and sold duplicate stamp papers to public who purchased from them in good faith and this has happened Tamilnadu also.
You may be aware that the Telgi Stamp Paper scam shocked the entire country during those years.
The CAG report in respect of the revenue audit conducted reveals that there was no proper maintenance of records and that there was no proper reconciliation of accounts performed as mandated by the Tamilnadu stamp rules of the accounts done. (I take your kind permission to draw your attention to clause 5.2.11 of the CAG report.)
If your valuable time permits, please go through the clauses 5.2.5, 5.2.6, 5.2.7 and 5.2.8 and their conclusion in 5.2.11 of the CAG AUDIT REPORT (REVENUE RECEIPTS) FOR THE YEAR ENDED 31 NARCH 2004.
With this back ground, as an affected party I wanted to know if there's any court judgement that safeguards the interest of the purchasers of such fake stamp papers and used the same to execute agreements.
Hope this communication clears your doubts. I still look forward to know if there are any court judgements on the validity of the agreements executed on the fake stamp papers purchased from LICENSED STAMP VENDORS.

You are referring to an unregistered sale agreement entered in a non judicial stamp paper of very less value.
But what is not understood that when was this sale agreement executed and why the non judicial stamp paper dating back to the year 1998 has been used now?
Did you buy the NJS paper now or were you holding the papers from the year 1998 in your possession and have used it now for the sale agreement.
The stamp vendors do enter the serial number of the non judicial stamp[ paper in their register for their reference and also for the purpose of future auditing.
If the sale agreement was made in the year 1998, it is not valid now because its validity is just three years hence i is barred by limitation/ Thus your question is still not understood that what you want to clarify, by your repeated posts.
Moreover you want suitable citation or judgment for an unclear and ambiguous question.
First you understand what you have written here and whether you have conveyed your thoughts to convince the advocates of this forum to enable them to give proper advise/opinion to solve your problem/.

Admittedly, the stamp papers had been purchased sale agreement executed more than two decades back? What is the relevance of the agreement at present?
