Contract agreement

(Querist) 07 September 2011 This query is : Resolved 
Dear Sir,

Can we enter in a agreement now for a work / service which has been started already? Eg. A service was started on Jan 11 and we are entering into agreement with the service provider now in a current 100 Rs stamp paper.

Is it valid one or not. Please confirm

yes, but you must be register the agreement then only valid as per legally

stamp duties are calculated depending on money involved at the date of execution subject to rate fixed by a state for which nothing can be opined without having a look on draft proposed.

The agreement you refer can be oral also so nothing illegal if it is recorded in writing at a subsequent date with suitable recitals as no registration is required how ever when decided to go by written,registration though
optional,should also be opted as that becomes greater in value of evidence.

Agreement for the part of remaining service with due mention of the service in totality as well as the part of service already rendered, can be made, which would remain effective from the date of entering in to agreement, provided the due amount of stamp duty is affixed on the agreement deed.

no sir. your agreement date can not be retrospective.. your ageement date should be on the date of stamp paper or after stamp paper.. but you can mentioned it by words.. i mean about earlier commencement
