Commuted leave

can a central govt. employee take commuted leave for few days without medical certificate. if so for how many days. what is the reference letter no.

What do you mean by commuted leave? There is no such leave in any organisation.

Download leave rules from shared portal of your establishment and go thru these and rely on these.

You shall get all references mentioned in it.

3.Commuted Leave:
Up to a maximum of 90 days can be taken during the entire service without medical certificate where such leave is utilized for an approved course of study certified to be in university interest.

a govt doctor writes in the prescription "Rest for three days"
is it sufficient or medical certificate/fitness certificate is still required. i am told that medical certificate/fitness certificate is not required for few days i.e. upto 3 days for commuted leave. how many days is few days. is it ok

Once again download Leave Rules from your establishment and refer to these. Leave Rules are usually very exhaustive and cover all aspects.........................


>> LEAVE RULES:

7. Right to leave

(1) Leave cannot be claimed as of right.

(2) When the exigencies of public service so require, leave of any kind may be refused or revoked

8. Regulation of claim to leave

A Government servant’s claim to leave is regulated by the rules in force at the time the leave is applied for and granted.


19. Grant of leave on medical certificate to Gazetted and Non Gazetted Govt. Servants.



(5) The grant of medical certificate under this rule does not in itself confer upon the Government servant concerned any right to leave; the medical certificate shall be forwarded to the authority competent to grant leave and orders of that authority awaited.

(6) The authority competent to grant leave may, in its discretion, waive the production of a medical certificate in case of an application for leave for a period not exceeding three days at a time. Such leave shall not, however, be treated as leave on medical certificate and shall be debited against leave other than leave on medical grounds.

It is felt that:

- if medical certificate is not found proper employer can decline medical leave too.
-if leave rules does not require medical certificate for sick leave of 3 days still employer for certain reasons as perceived by him can ask to provide the opinion/Rx/Medical Certificate from doctor.

Commuted leave cannot be granted without a medical certificate on prescribed form granted by the authorised medical attendant. Advice for "Rest for three days" on prescription slip cannot substitute a medical certificate on a prescribed form. Advice on prescription slip is meant for you not for the leave sanctioning authority.
