section 138 says that "a term which may extend to one year", or with fine which may extend to twice the amount of the cheque, or with both"

So, its totally depend upon court's judgement on case.

The provision of N.I. Act,accused be with imprisonment for which may be extended two years or/with fine which may extend to twice the amount of the cheque or both.
