Change of name in proprietory firm

Dear All,

I have a proprietory firm from past 3 yrs in mumbai, i now want to change its name (it will remain as proprietory firm), is there any legal formulaties for the same or i can directly apply for new set of documents in new name and open a bank account in new name.

I have Service Tax Cert in old name and a bank account.

Is the firm registered under Shops & Establishment Act?

If no liability exists on the part of the existing firm, close all the activities of the firm, get all the formalities completed with the authorities, wherever registered, and open a new firm by completing all the opening formalities of a new westablishment afresh.

Open new firm, get licenses and tax registration in the new name.

Meanwhile close the activities of old firm, pay liabilities if any, surrender tax registration.

Beyond above mention option, U may get amendment in service tax registration,Bank will guide u for new A/C or existing account.New Firm will loose seniority in market as well as in papers.

Best to open new firm as you wish and consider closing or defuncting old firm.

You may opt for closing the existing one and open a new one afresh provided the formalities for closing the existing company are followed scrupulously.
