challenge of Registered Will

Querist : Anonymous (Querist) 18 October 2010 This query is : Resolved
My grand mother was having a property which she had transferred to my mother by a registered will. As now she is no more, Can my father's brother, sister may challenge the will?
Devajyoti Barman (Expert) 18 October 2010
Only those person can challenge the Will who could inherit the property had the Will been not executed.
In your case, the brother and sister of your father do not have any share in the property left by your grandmother and hence there is no chance that could challenge such Will.
Adv ramesh chheda (Expert) 19 October 2010
yes they can do so as they are legal heirs to u r grandmother who is not maternal but paternal, provided large period is not passed. but their success wil be very much minimum as this is registered will.
adv. rajeev ( rajoo ) (Expert) 19 October 2010
If it is grandmaa's self acquired property then will executed by her in favour of your mother cannot be challenged.

Dear Querist,

Please note that ahe Will of any person takes effect after his death and the contents of the Will have to be read, understood in the manner they have been written. If the immovable properties included in the Will in favour of your mother have been that of a self-acquired one, then the said properties go to your mother being a named beneficiary of the said particular property. In other words, if your grand mother has specifically bequeathed a property in your mother's name in her Will, then she can become the owner of the said property and only thing your mother has to do is to obtain probate of the Will in accordance with local law, if necessary. Please consult your lawyer seeking legal advice for probate of the Will in favor of your mother.

I like to thank all the experts for their suggestions.

May I know about the meaning of self acquired property. The property is registered at the name of grandmother and deed of house property is at the name of my grandmother.
