I have field 125 cr.p.c case on my husband. next date is fixed for rebuttal and argument.My husband denied that he is not earning RS\=10000.I have not tender any income proof of husband in my evidence stage.

MY QUERY ; CAN I TENDER DOCUMENTS ON REBUTTAL AND ARGUMENT STAGE.

WILL COURT CONSIDER THOSE DOCUMENTS.

you can make an application that you desire to lead additional evidence . court will permit you to do so

Documents in rebuttal can be filed if those were necessitated by evidence led by respondent but the income proof is not such document so it is better for you to lead additional evidence with prior permission of court.

Unimpeached documents can be considered for interim maintenance order but not for final order. Those documents must be proved. I do not know about stage rebuttal.It is new for me.

yes u can make ur prayer before the Hon'ble court for "Additional evidence" and once the court admit then it become easy to move on.

As I know in Family Court Act/ Rule there is provision that any document which is necessary for just decision of the case may got exhibit mark without any formal proof.
