CASE OF 420 AND 120

As per the railway tender I had supplied material to a contractor. There was a CBI raid on the contractor and CBI found evidence of gratification made to the railway official, they also raided my office, but found no evidence of wrong doing, but during the enquiry they kept on telling me that I might have colluded with the contractor and the govt official to get through this deal. Now they have filed a case and summons have been issued to me as an accused under sec IPC 420 u/s 120b sec 13(2) r/w 13(1).

So I have to be in the court on the 18.11.10 so then what should i do next ? take a bail ? will I get one ? what kind of bail will i get ?

You will get bail and thereafter you have to face trial.The bail will be regular bail granted under Sec.437 Cr.P.Code.

Yes, when you appear on the particular date you have to apply for bail and once it is granted you have to face the trial unless you are discharged in the meantime.

On appearance you will be given the copies of the charge sheet and other documents relied on by the prosecution. You will be asked to appear on another date for questioning. On that date your plea will be recorded by the court and the case will be posted for framing charges. Before that you have the opportunity to file a petition seeking your discharge. Once charges are framed,you cannot seek discharge. If you do not seek discharge, the trial will proceed.

Thank Sir. you said bail will be granted under regular bail granted under Sec.437 Cr.P.Code. Can you also tell me what kind of conditions will be imposed on me in the bail granted . And will it a personalbond and what value or will i have to produce sureities. The case is in kerala and i am in tamilnadu

It may be against your personal bond as well as sureties of such value as may be prescribed by the Court.

I agree with Mr.Subramanian. The bail conditions will be prescribed by the court as Mr.Gupta rightly said.
