Querist : Anonymous (Querist) 01 July 2010 This query is : Resolved
What is the difference between disposal and dismissal of suit?
Y V Vishweshwar Rao (Expert) 01 July 2010
A Case will be diposed by considering the calims of the party , it may be dimissed on merits or it may be decreed on merits or on consoderation - exparte

Difault -Disposal of the Case by dismissal for defualt - it is also disposal of the suit without considering of the Claims of party - as it is default not proceeded with by the party /plaintiff - dismissal in default
Devajyoti Barman (Expert) 01 July 2010
Disposal means when the court passes any order i.e. allowing or rejecting the prayer relating to an interim petition after which no more order could be passed with regard to the same petition.
Dismissal means when the court refuses to pass the order granting the relief prayed for by the petitioner through the same petition.
Mind it all dismissals are disposal but all disposals are not dismissals
adv. rajeev ( rajoo ) (Expert) 02 July 2010
When the order/judgement is passed by the court on an application or decided the case on merit is known as disposed off.
dismissal : Some times cases will dismissed on the merits and some times for default.
Raj Kumar Makkad (Expert) 02 July 2010
