NO
we CANNOT attach agri land for failure of cheque bouncing case

CIVIL COURT PROCEEDING REQD TO PAY COURT FEES DEPEND UPON THE VALUATION OF THE SUIT.
Advocate. Arunagiri (Expert) 13 December 2011
Mr.Khan,

Your question is mixed up with so many legally unconnected issues.

In Cheque bounce case you can not attach any property.

Civil case is a different case, you need not deposit any thing, you have to pay the Court fee. Here also you can not attach a agricultural land.

agree with experts .. u can ask for warrant of arrest of that person. with the fear of arrest he will be paid your debts immediately.

You can file a civil suit on the basis of cheque bounce and can get the property of the defendant attached and can also got those auctioned as per CPC.

i agree the same is possible only by a civil law suit not by 138 N I Act.

I agree with the opinion of Shri Arunagiri. You may better come forward with the real problem. To be very frank, an idea of attachment of agreeland seems to me also as if there is some bad intention to acquire agreeland of some person illegally by dubious means just to deprive of the means of livelihood of that person on the pretense of bouncing of his cheque.

Attn Mr.dhingra

sir,

we also dont want to do this to anybody but how can we get our money from him can you suggest me? he is not poor and his two sons are doctors and living luxury life
V R SHROFF (Expert) 19 December 2011
Mr. Akbar Khan,
If they are Rich & Dr., Best way to file 138 N.I. Act, get NBW, do not compound, let then attend court as accused, many times , let them stand there for days together, go for arrest & conviction, you can achieve your target.
