Can once notice serve after ward no notice from court,can nbw issued only one notice

under NI act 138,one notice was serve but due to bad health of my mother,i could not appear in court and after ward no notice was serve,but court isseud NBW without serving any secondary notice,court might have issued notice but not serve to me.
can we challenge NBW as illegal or better to take bail from court

Court has used its power and you need only to get bail instead of wasting your attention towards futile exercise.

You are advised to file recall petition immediately, otherwise she will be arrested by the station house officer.

When the case was first posted, you could not appear as your mother was sick.

Did you find out from the court as to what happened on that day? Did you find out from the court as to the next date on which the matter was posted?

These are your duties. Once a matter is posted and you have been served with a notice, thereafter it is for you to keep a watch. The Court need not send the notice again and again to you.

Thus, having failed to make appearances whenever the matter was posted, you have exposed yourself to the issuance of the NBW. Better get in touch with some local lawyer and do the needful without wasting further time.
