Sir/Madam
Whether the captioned form can be accepted from HUF/Trust in respect of Section 197A(1) & 197A(1A)for no deduction of TDS.
This query has been raised by keeping in mind the Circular no-351 dated 26.11.1982 reference of which still is still remaining with the said section.
Also the new format of 15G vide Notification No-11 dated 19/2/2013 muddle it by note.4 wherein it mentions '**Indicate the capacity in which the declaration is furnished on behalf of a HUF, AOP, etc'
Please guide

31. Recovery/Refund of overpayment of pension to the Government Account.
(Ref. DGBA. GAD. No.H-10450/45.03.001/2008-09 dated June 1, 2009 and DGBA. GAD. No. H-2434/ 45.05.031/ 2009-10 dated September 15, 2009)
Government of India have advised us that the over payments of pension made by the banks are not credited back to Government account by the banks in lump sum but are remitted in installments as and when recovered from the pensioner. As this causes loss to the Government, all agency banks have been advised that whenever any excess / overpayment is detected the entire amount thereof should be credited to the Government account in lump sum immediately. We have reiterated instructions issued vide our circular dated April 18, 1991 and June 1, 2009 for recovery of excess payments and lump sum refund of excess/ overpayments respectively.
Would you please explain "As this causes loss to the Government, all agency banks have been advised that whenever any excess / over payment is detected the entire amount thereof should be credited to the Government account in lump sum immediately"

Mr "X" (staying abroad) is a owner of a flat in our society. Mr. "B" is Power of Attorney Holder of "X" since 2002. As per PA Mr.B can sell the flat. The flat is on Rental since 2002. Now B wants to sell the flat. The PA Holder has submitted letter for NOC to sell. Society has not seen the owner since 2002.
Please advise us how Society should deal this transaction so that it in accordance with Act and Bye-laws of the society.

My father has been leasing out his property (in Kerala Thrissur Dist.) about 2600sq.ft from 2002 to a particular lessee where he is running a supermarket. There has been no renewal of contract since 2008 and there was a revision of rent once at 2008. The latest contract had the clause saying that the lessee will be ready to move out once the contract expires and lessor says so. Lessee has been giving the rent (the rent is way below the market rate and lessee is not ready to give a higher rent) regularly and he is still continuing. We would like to get him out of the possession. Does the law stay with us?

Respected Sir/Madam,
My relative(male) took many loans over the years from money lenders and friends, which, due to high interest, he could not pay, and the loan sumed up-to 1.5cr. He gave blank signed cheque to many. Unable to pay the loan he ran with his family to someplace no one knows as advised by the lawyer. He has police case on him and the blank cheque he gave came back as there was no money in the account. The lawyer/relative has kept a IP case in court(Don't know what it is, all I know is if you can't pay the loan with all your property and salary the court grands you a option not to pay). But its been 2 years but the numbering didn't come till now, the lawyer keeps telling 2 months, and extend the date( I don't mean any offence to the lawyer). And he says you don't have to come to the court, I will see everything, after the numbering comes, in 2-3 years the court will grant the case in your favor.IS IT POSSIBLE???. His daughter is studying in a different state, Loan people said they will take the money from her after her studies as her father used her studies as a reason for loan(and maybe took loan on her name, I don't know), SHOULD SHE BE IN CONTACT WITH HER PARENTS, loan people already know where she studies and came to her for her father location but she didn't tell them and booked a police case and they went away. DOES THE DAUGHTER HAS TO PAY THE LOAN??. WHAT CAN SHE DO NOW SO THAT SHE WONT GET IN ANY TROUBLE. it will take 3 yrs to complete her studies. WHAT SHOULD SHE DO SO THAT NO TROUBLE COMES TO HER. Please reply soon.
THANK YOU...
