Hello Sir,
Few years back we took a loan of Rs.2,00,000 from a local person at a interest rate of 5% and we paid interest for him for a year through cash (no receipt given) and last year may we had cleared the actual amount of Rs.2,00,000 through check and we are due to pay around 25,000 of interest and we requested him and said that we cant pay the interest. He ignored us and did not give our papers and cheques (everytime we ask, he says to come later) and after few months he asked us to pay an amount of 40000 as due. We said that we cant give any money as my father lost his job. Today (9 august) he sended a notice saying that we are due to pay Rs.4,00,000. The notice says that we borrowed the amount in january of this year and promised to pay in 4 months and there was a check bounce also mentioned in it.
He included sections 138 R/W 142 of negotiable instrument act,1881.
But we gave the actual amount to him last year through bank. Moreover the promisery note and cheques were around 3 years old.
Is there any way to prove we are innocent?
Please help us with your valuable suggestions.

498-a, 406,- pending
u/s 125 - Rs. 1500/- per month - paying regularly.
u/s 18 of HAMA - pending
u/s 405,406 r.w. Dowry proh. Act - dismissed for want of prosicussion.
u/s - 9 - pending
u/s 24 of HMA - decided Rs. 1500/- p.m.
i want divorce - all cases are running in other state where wife is residing with her parents and 498-a is running in my city only.
in sec-9 which filed by my wife only for harrass me and to take sympethy from hon'ble courts, i personnaly appeared before court of CJSD and asked him to sent my wife with me, but my wife told that she wants to cohabit but she is having threat to her life from me and she wants guarentee of her life in written. than i told to judge that i am ready to give in writting and u send my wife with me today itself. i also told to judge that i am coming to attend these various cases from the distance of 1000 kms. i m alone son of my parents having one married and one unmarried sister and parents are also totally dependent on me.
than judge sent the matter for mediation to other CJSD court. this court has given three dates i attended all of them and told the judge my side but she or her advocate not attended any date of mediation. then in third date the judge make failed report and take my sign and my advocates sign on the report and sent the report to main court.
than i appeared in main court where case is running and asked him that she has not come in mediation now what should i do, then judge told me that if she not wish to come before mediation court i cannot forced her. than i filed a application before the court u/s 151 for postpone decision in sec 24 and daily hearing of sec. 9 , as coming on each date or frequently to attend court from the distance of 1000 km is not possible for me.
but court has rejected my application and decided the sec. 24 and granted Rs. 1500/- p.m. and Rs. 100/- for each her personal attendance on date and Rs. 3000/- for legal expenses.
i want to mention here that she filed all these cases with in few dates as per below-
1. Sec. 498-a, 406, 523 on 22-06-2006
2. Sec. 9 & 24 of HMA- on 03-07-2006 (affidavite on 27-06-2006 i.e. after 45 days of filing 498-a) and i received summons of sec-9 on March 2012 only i.e. after 6 years of filing of sec. 9
3. Sec. 125 - on 05-07-2006
4. Sec. 18 of HAMA on 11-07-2006
5. Sec. 405,406 r.w. Dowry Proh. Act.- Nov. 2006.
i am in serivce in a PSU. she filed RTI is my office and collect my pay slip and filed in court of getting more amount in form of maintenance. she just want to harrass me and don't want to give me divorce.
she has completed her law degree now.
i filed various documents in sec 24 about my expenditures, medical expenses of my parents and sister's education expenses and my up-down expenses towards my service.
also filed the court receipts of paying maintenance in case of u/s 125 Rs. 1500 pm regularly.
all above facts i given before the court that her intensions are not good, and she using these all legal remady for harrassment of me and my family members only.
now what should i do.
1 whether filed appeal against order of sec 24 .
2. file divorce in my city .
or what other remedy is available for me . i am very much tired now from all these meaningless legal bettle.
i know that their is no justice for right side.

if minor 16.5 years aged girl being kidnapped by any accused person and fir got registered u/s 363,366a,120b and accused was jump away with setting of police officers ,pre bail was dismissed by session & also high court,accused personals announced proclaimed offender by court, now in the august girl is complete their age 18 please tell me what is option of statement of girl if she give in the favor of kidnapper these statement is valid or not . because police not arrested to accused for giving chance to accused due to setting with accused for completion of age issue
clearly i not want compromise at any level or condition with any accused
i have filed a case in lokayukta against police officers for setting with accused personals with corrupt hand lokayukta have issued finaly notice to sp or i.o for personally on first date and inspect all proof of complainant or poolice record

Three year ago I was fined by the court.
I was walking to my hostel and was drunk, caught by the Police and later fined by the court. Is this create problem in getting government job??

Hi Respected Members,
Can experts please shed light on weather duplicate/copy deed which is made on 100 rs stamp duty and registered along with main partition deed can be treated as title deed?
Is there any law or act supporting this?
Will banks accept this copy deed as a title deed for creating equitable mortgage?
Also, if copy deed is not a title deed then what options can opted so each party in partition deed gets a title deed paper.

Hi All,
I want to sue the Reliance BIG TV. I know it is a small compliant I have.
Complaint: I paid for one year activation on Nov 18th 2013. I called the customer care at 4:26PM and made the bank transaction at 4:30 PM.
Now in August, they say that I only called in for checking on my account but did not inform them to activate for one year. So they only gave me 9 months of service.
I am not stupid to pay the amount of 1 year activation around the same time of my call and not tell them to activate it for an year.
I have lost 3 months of service due to negligence of an employee.
If they say that they cannot help me, I want to sue Reliance. How can I do it?
This is how big companies make profit out of nothing. This is how they become so rich. I want to teach them a lesson.
Please advice.

My client served in ICICI bank as Asst. Manager since last 3 yrs. he completed his probation and got promoted...he achieved appreciations from bank for his work efficiency...due to prejudice from his seniors he terminated with averment of getting commission from customer..without evidence...which court has jurisdication when the bank like ICICI, HDFC etc are private bank?
Industrial Dispute Act can't be applicable in this case so confusion is civil court has jurisdication or directly highcourt will decide or other jurisdication available?

Transfer of society shares certificate and membership
Hello,
I have purchased resale flat @ 1.9 years ago in Dhanraj Park, Kaspatewasti, Pune, Mharashtra, India.
It is seen that despite of paying society transfer fees of 25,000/- rs, my name is not yet reflected/changed on share certificate.
I had requested for transferring share certificate to my name but they asked to pay membership fees of 10,000/- Rs.
Untill i pay membership fees they refused to change the my name.
What is the limit on society membership fees?
I read that "A member of a housing society who has sold his plot or flat on the power of attorney or agreement for sale or by sale deed, shall cease to be a member of that society from the date of the sale of plot or flat".
What is the limit on society membership fees? What is next step for me to do?
