Partition

In a partition suit the sisters & mother were the Plaintiffs and the Defedants are their brother. The preliminary decree has been passed, in favour of the Plaintiffs. Thereafter the mother of the Parties died leaving behind two daughters & three sons as legal heirs. In such a situation the share of the mother/plaintiff has been devolved upon both the parties. How the final decree would be drawn under such circumstances?

court can take a suo moto action in amt. of sale deed

Dear Experts.
Fact of the case - I want to purchase a house of minor and as per the relevant act court permission also avail. Now I want to do a sale deed with the guardian of the minor who has right in property. We mutually decided 100000 rs. For house . But as per the jantri its around 300000.
Now my question is can court do interfere in this matter or can suo moto take action, saying that consideration of house property is too low.
As per court order guardian have to submit saledeed in the court.
Advice me.

Minors right to challenge a partition deed

This is with regard to a property owned by Mr.A and Mr.B.On death of Mr.A the property rights of Mr.A had devolved upon his legal heirs. So the property was jointly owned by all legal heirs of Mr.A,(which includes his wife and two minor daughters aged 16 and 10)and Mr.B.Subsequently, all of them jointly executed a partition deed in 2014,wherein the minors where represented by their natural guardian, mother. In the partition a larger extent of property was set apart as Mr.B's share. My clarification is
1.As a minor has the right to ratify a transaction likewise, whether a minor on obtaining majority can challenge the partition stating that they enjoy substantial right over Mr.B's share also.
2.If such right to challenge exist, can be imply that minors interest exist in Mr.B property till the limitation period of three years expires.

Cyber crime by icici bank

This is with respect to loss of Rs.34,294 which was withdrawn from my ICICI SB Bank Account.
These transactions happened as under received via SMS on my registered mobile no.

I have informed the bank immediately when the transactions was happening and was on hold for 5 minutes from 20:20 on 28/7/2014 and I was receiving the debits SMS on my mobile. When I got connected to customer care I told him to block my card immediately and intimated that these transactions were not done by me.

She confirmed that she has put those transactions on dispute and also told to lodge FIR in Police, and post submitting FIR copy I will get reversal of amount.

I have submitted the FIR copy and bank provided me Complain number as SR 331550652.
I have received the letter from bank stating that they will not be able to reverse the money since the transaction was done through 3D secure Pin

I have not shared my Pin with anybody, also I hardly do online banking.

I have informed immediately to bank to hold my amount, inspite of that bank is not returning my money.

Also I have told bank to provide IP address, bank is not providing any information.
I dont know what to do now, it happened on 28th July.

Criminal trespass of property!

Dear learned lawyers,

My father owns a small piece of land near Mangalore, Karnataka State perched on top of a hill with a slopy terrain!

A land owner of the adjacent property has sold his plot to a broker. This broker has made a deep vertical excavation starting from my fence downwards to a depth of 50 feet, which has led to a substantial landslide resulting in loss of my land due to the landslide, and there is further fear of more landslide occurring due to loosening of soil. In this context, can I pressurize the police to file an FIR against this broker for "criminal trespass of my property" and what will be the effect of the FIR on the broker? And what other best action can be taken by my father, who is a sr. citizen to get quick justice and compensation for the loss of property?

Thanks in advance!
