Hindu- christian marriage

One of my clients is a Hindu, living in India. His fiance is an American Citizen, based in the US. They intend to get married in India, but want to avoid the 30 days residency period under the Special Marriage Act. They intend to get married as per the Christian rituals in a Church. I want to know the exact procedure of the same. Please answer only with respect to Christian Marriage Act and not the Special Marriage Act. The Act says either of the party needs to be a Christian and not both. Please clarify on this and the entire process.

Removed from service due to unauthorised leave

I was working in PSU insurance company. I was served charge sheet in June 2013 for loss of pay for 380 days. I was on loss of pay for the period mentioned but it was spread over four years. I accepted the charge and replied on 05.08.2013 that all these LOP were taken for UPSC Exam preparation. I resumed my duties on 19.12.2013 and continued till the date of removal from service i.e. 19.09.2014, for a period of nine months. I was under an impression that since I am sincerely and regularly working the Disciplinary authority will consider this and impose a lighter punishment.

Do I have any ground to challenge against this order in court of law? A provision of appeal is with me. Can you guide me in preparing my appeal?

Impact of order reserved on interim decision challenged in high court

Hello Experts,

Thanks for all this wonderful FREE legal advices.

Last year I got interim order against me and I had challenged the same in High Court-Delhi (Sec-482 CRPC), however no stay order is received from high court.

But before next hearing of high court(7th Nov 2014), district court judge has reserved the judgement on 29 Oct 2014 and have given new date of 11 Nov.

My Question is as my High Court hearing date is before District Court hearing date, does order reservation requires me to do something?

like: withdraw case from high court and wait for final order from district court then file case in high court u/s 397

Advise

need advise for a friend she is in a relationship with a married man.
he is not happy with his wife and no kids involved but she is refusing to give a divorce. she is threatening him of all types of allegations extra marital, alimony, suicide and blaming both of them etc.
wife and mother-in-law is threatening to falsely implicate her saying she is bad charactered etc n will get her thrown out of her house (tenanted)by getting false evidences from the neighbours, get her beaten up, arrested etc.
Is all this possible ?
kindly advise the best way out legally for both of them to be happy together

Restriction for leasing flates to bachelors in apartment

Dear Sir,

I am residing in an apartment with 30 flats. this Building is located near a Engineering college, so many flats in the building has been given to students on rent. Because of this the families are facing problems like for example loud noise during night or late night parties. The society is not yet formed. And majority of flat owners have given flats to students, so can we take any action or ask legally the owners to restrict on leasing their flats to bachelors or student?

Arbitrary cancellation of registered plot by of navyugsehkariavassamiti ltd

Arbitrary cancellation of registered plot of land by corrupt Secretary of NavyugSehkariAvasSamiti Ltd., Meerut (UP) and officials of UP AvasVikasParishad.

I am Sundeep Sharma, currently working in Singapore and am a member of the NavyugSehkariAvasSamiti Ltd., Meerut. Recently the secretary has sent a cheque No. 590143 dated 02Oct2003 of Rs264306/- drawn on Punjab National Bank along with a letter stating that my plot has been cancelled. I have invested my hard earned savings in this small plot of land with a view to make a dwelling in future to settle as a part of my retirement plan and am under tremendous stress since receipt of this letter from the society.

I do not understand how a legally registered plot can be cancelled after a span of more than 10 years.
• I was allotted a plot No. 58 in year 2003 in SwasthyaVihar colony developed by Navyug Sahkari Awas Samiti Limited, Meerut (UP). I paid Rs. 45000/- as per the rate fixed by the society and the plot of 150 sq yards was registered in my name on 03Mar2003.
• Over the last 11 years, the land rates in the area increased and the vested interests of the Secretary of the society came in picture. The managing committee of the society completed its term and further elections have been wilfully prevented by the Secretary in collusion with officials of Avas Vikas Parishad.
• An amount of Rs. 2 lakh, which is equivalent to about 4 times the original price of the plot as development charges (असुधारशुल्क) by getting an order issued by UP Avas Vikas Parishad for the same. This amount was collected in June, 2012.
• However, no development of the colony has been done and no plan of action has been conveyed to the plot holders.
• Instead of working for the welfare of society and its members, money collected as development charges is being used to initiate cases in Avas Vikas Parishad and various courts against members to harass them to pay more money.
• I have never been provided the audited account statements of the society.

These people are neck deep in corruption and have been siphoning away money from the accounts of the society.

Now, I suspect that the Secretary, in collusion with corrupt officials of Avas Vikas Parishad have the ulterior motive of re-selling the already allotted and registered plots to other people and sharing the black money so generated.

Is it legally tenable to cancel the allotment/ registry of the plots and what is the re-course available to fight this irregularity.

1. who can cancel land rent receipt.
2. pangian 2 (thoka) who can stop/cancel it.
3. after how many years we have to seek permission of circle officer for no payment of rent receipt.

Reply to a legal notice

Good Morning sir/ Mam,
I am a Civil engineer; previously I was working as a civil contractor in a real estate company.
I was in touch with a person through one of our mutual female friend, once I was in need of some money, that time my female friend asked that person to help me and he deposited the sum of Rs. 15000.00 + Rs. 10000.00 in my account. After some time he asked me for money return and then I deposited the sum of Rs. 19000.00 only in his account. (Now I don’t know the account no.), after a period he started claiming 10% compound interest on his 25000. and forced me to pay Rs. 87000 more. I was in a big trouble.
His female friend also told me to pay the money with interest. Then after I issued two different dated cheque of amount Rs 50000 and 37000 of my business bank (Current account of my construction firm.) I told him when I will ask you to deposit the cheque then after you present the cheque in bank, but he did not listen to me and deposited those cheques and they ware bounced 10 month before.
This matter happened A Year before and those cheques has no credibility.
There is nothing between us in writing. Now he is making false allegations that he gave the sum of Rs 350000.00 (25000 deposited in account and rest in cash) and I ware promised him for flat (property).
He sent me a Legal notice and asking for make the payment otherwise he will go to court and file suits U/S 1860.
I am going denial of all allegations makes by him through a lawyer, my question about the cheques, what reasons I should have to put for issued cheques.
is it be Good if i say that i ware issued post dated cheques for the supply of materials, neither he supplied the materials nor i made payments ?
Please guide me that how to respond Please reply as soon as possible.
