In the Mumbai co-operative court, i had strongly denied and requested not to accept the WS of the respondent as the respondent intentionally took unnecessary dates for 221 days, just to prepare the WS. But the court accepted the WS and ordered the respondent to pay me the cost of Rs. 300/-.
My queries
------------------
Is the cost of Rs. 300/- ordered by the court reasonable and what is the criteria of compensation in such cases?
Is it an injustice to me that the court accepted the WS inspite of no valid reasons given by the respondent and still delaying the WS preparation for 221 days?

Dear Experts,
I am a resident and domiciled in Maharashtra. My ancestors have a immovable property in Kerala in which my Uncles Daughter by name Lakshmi alone was living. She was not having any children after her wedlock. She was taken care of by my mother til the date of my mother's death in 1989. During the period Lakshmi was also doing some hosehold work such as grinding wet rise, drawing water from the street wells of the Village for the persons employed her for the domestic service. She was not paid any amount for her service rendered by her to them under the pretext of accumulating the same with respective person. After the death of my mother she continued to stay alone in the Ancestral House which is situated about 6 kilometers away from my mothers house. After passage of time Lakshmi became sick which was not communicated by anyone of the villagers or the Brahmana Samooham a Society registered. But one of the members of the said Society holding the post of President purported to have spend Moneys for the treatment of Lakshmi who died in the year 1994. This incident also were not known to my brother older than Lakshmi, who resides at his mother's house. Now under the guise of certain fabricated documents purported to have executed by Lakshmi the President has occupied the ancestral house and the said Society members also has planted to take over the said property for the Society.
My brothers on behalf of all the legal heirs approached the Society to free the said property and offered to pay the amount spent for the medical treatment and also for spending money for her cremation. Now the said President is making the payment of property tax to the Municipality. My brother had filed a suit for injunction which was dismissed by the Court. Under the circumstances I would request the experts to suggest legal remedy whether;
(1) CAN I FILE A COMPLAINT BEFORE JMFC,IN MUMBAI.
(2) CAN MY BROTHER FILE A SUIT FOR TITLE BEFORE THE DIST. COURT CIVIL SIDE.

Dear Sirs,
Court has appointed a Receiver in 1994 to manage the Trust property. But suddenly he died on 9 Nov 2014.
These are my queries:
1. How to Inform the court regarding his demise.
2. Within how many days it has to be informed?
3. Who's duty is to inform the court? Is it the trustees or his sub-ordinates?
4. If they fail to inform, under what section of law, they can be punished?
5. Without a new Receiver appointment, does their sub-ordinates can act as Receiver?
6. Without the appointment of new Receiver, does the trustees can take-over the property?
7. If question no: 6, is yes (or) no. Please provide the section details about the punishment
8. Regarding to the above issue, where I can find the section details & where to refer in the law for further more details.
Thanks in advance.

My family friend has filed a 498a on her husband. Incidentally the husband is also an family friend of mine whom I have known for the past 30 years.
The wife has made me as an witness (independent) in the FIR and I also came to know through the husband that 161 statments by me and my wife are part of the case.
However neither me or my wife had given any statement to police nor we have been enquired.
I want the families to be united. My questions
1) How do I get out of this mess and clear my name out?
The case is only in the FIR stage.
Builder issues
Hi
I am from Hyderabad and we purchased a flat from a builder which was in construction phase 2 years back and occupied it last year December. Even at that time the out side works and common area works were still going on. Even now there is some works like painting etc still pending and already walls developed cracks. When we questioned the builder is not responding / giving adament answers. What shall we do? Kindly advice. We already formed an association.
