Workplace harrasment and bullying & late working hours

Hi,
I would like to know what are the laws for ideal working hours in an organization. What are the remedies if an employee is made to work for more than 9 hours a day. In countries like Australia, there is Fair Work commission, what are appropriate bodies in India and especially Maharashtra.

Relieving from my company

Hi all,

I am working in a company from last 1 year. I got another good opportunity which I accepted.

With my previous company there is an agreement reagarding minimum years to serve.Since I am leaving my company, I am ready to fulfill that agreement. I need to pay certain amount as compensation.

Now there is no mention of notice period on any of my documents such as joining letter or appointment letter. When I talked to my HR, HR was saying that I need to serve a notice period of 3 months and at the same time they were telling me to stay back saying that they will not accept the compensation.

It was told to me that If I leave, then they will not provide relieving letter as well as experience letter.

They were saying that we do not mention notice period on offer letter,its present on HR web portal.But my point is, notice period must be mentioned on joining letter/offer letter since they can modify the notice period on their HR portal anytime.

In the end, I have submitted my resignation and now waiting for the meeting again.

From my side I am ready to pay compensation.

Please let me know how to tackle this situation.

Transfer through gpa holder holder

dear sir,
there is a plot which was in the name of party 'X', which was transfered to person 'Y'by registering the sale in FY 2003-04.

DUe to the death of 'y' , the property was transfered to his wife 'mrs.Y' (legal Hire)in FY 2006-07.

Since then, Mrs Y has remained the owner of the property.

In FY 2011-12, Mr.Z, brother of Mr. X, by representing himself as the GPA holder of Mr X, transfered the property to his wife, Mrs Z., while Mr. X was no more the owner of the property at that point i time.

But, the EC report generated in FY 2014-15 says that the owner of the property is Mrs.Z.

is this possible?
if yes, then what is the procedure to go about it?
what is the criminal offence to be charged to this fraudulent act?

can you please help me out.

Communication with un recognised union

We are a Defence Public Sector Undertaking. We are having five registered unions of employees. Recently the Labour machinary had conducted referendum for ascertaining the majority union and issued a letter that one union , which have emerged with large no. of members to be recognised for two years. The management accorded recognition to that union. Few other unions are making correspondence with the Mangement on various issues including issues of common nature. Management is of the view thatr since a particular union has been accorded recognition, we should make correspondence with them only not with others. Is it legally correct? Whether the other unrecognised union have any right to be corresponded by the Management on their letters?

Null void marriage and maintenance / alimony

Hi Experts,

Would appreciate your valuable opinion in my case.

Scenario and events :
I got introduced to girl through matrimonial website and Got Engaged in Nov13 and Marriage to place in Mar14.

Upon narrating the stories she was murmuring on 1st night to her mother. They came to me next day with some relative to my home and apologised saying she was kidding on 1st night.

I thought maybe there is some misunderstanding gave her another chance and kept her with me and again i observed weird behaviour of her on next day and she threaten me of suicide. later again called her mother narrated her whole fact then her mother said to me that she has been haunted with some ghost and we are coming and will take back her home and will treat her and get back to me later. Since then she staying with her parents.

There after i came to know that she was hospitalized for 10 days and undergoing some treatment under physiatrist.

Realising the fact that i was cheated.
I talked to my lawyer and i filled a case against her under sec 11 of hindu marriage act within 5 days of marriage, as my marriage was not consumed and she is mentally ill . As per my lawyer suggestion i have stopped communication with her since then.

Q1. would like to know how can i get the hospital records of her from her native.?

Q2. They have not given any SAY against my petition till yet. should i compel them to do so ? And they are demanding xxx amount as maintenance and alimony. what should i do ?

Q3. I have some digital evidence of her weird behaviour but no original recorder. Although i have some copies of it. want to know how i can use this to win the case in favor of me.

Q4. What about out of court settlement and what consequences, how do i do this.? As per councillor suggestion.

Now It's effecting my job and i am on the edge of losing my job.
please help me with lawsuit.

dear sirs, we hav gav advance for property by oral with 3 months time. Now we ready to give balance amount and get rigistered. He dont agrees and demanding more amount. We recorded phone conversation after he refused to oral agrement. In phone he agreed oral agrement.phone cal record can valid as evidence. Thanking you sir.

I have file the case 377 & 498 (a) against my husband and in laws. But they got a interim bail in session court for section 377. As far as I know 377 is non bailable crime. I have done my medical test and its positive. What should I do now to arrest them? Please help me

Can a divorce daughter who is advocate get a family pension..?

Dear Sir/Madam,

Please advice/your view ...

A Lady advocate who is divorced on year 2005, her father was a Central Govt. Servant now she is earning from Advocate-ship (Rs. 1000-2000 per Month) but not sufficient for his life . She claim to her father office for Family pension...

Can advocate eligible to get the family pension ?

Who will get her Income Certificate. Because PATWARI/Tehisildar said that his power to above 55,000/-. (Fact is she earn from rural area Rs. 1000-2000 per Month)
