I have been accused in a FIR by the opposite party that 'While traveling at night at around 12:30 AM, my small vehicle which I was driving negligently and at a fast speed and collided with their vehicle which was on right side of the road. The vehicle of complainant was a dumper and was carrying a business assignment. My vehicle was a small four wheeler.

In the witness the driver and the owner of vehicle who was in the dumper accused me that I was driving rashly and because of the I have run over seven bulls sleeping on the national highway and then collided with them.

They have also accused that I might have been drunk. Although no such proofs exist. After the accident, my vehicle which was damaged was however in its right side of the road. And I was taken to a nearby hospital to attend my minor injuries like bleeding from nose and mouth and I wasnot there on the spot when police arrived.

How much punishment I can get from this case or will I ever get acquitted? Does the witnesses of the other vehicle count?

Money

Sir
Local people around my area collecting money for temple functions. We have government people say executive officer appointed by government for temple administrations function under him 3 staff works.

Local people collect money in name of temple and utilize money as they feel and is not showing expenditure list. As function is in temple can we approach court to make excutive officer responsible or should he a chairman under whom money to be collected .Many people give money in thousands and many dont and people who pay more become babus and great people .so can i approach court for this and what all formalities should i take to get this done

How many vaida opponent can get

Dear sirs

I have registered a civil case for getting permanent injunction in erode district court. for last two and half years opponent did not inquire us keep getting vaida. I would like to know how many vaida they can get. can we(our lawyer) do anything to not getting vaida.

Indemnity bond by vendor

One of our vendor has requested not to deduct TDS on his bills and ready to execute indemnity bond.

Can we execute Indemnity bond as such ? and if yes will that be on stamp paper or mere letter will do ?

Service tax applicability on franchisee providing services which are service tax exempt.

I want to know whether a Franchisee providing clinical laboratory services and generating a revenue over 10 lac P.A, would the Franchisee pay Service Tax on the Royalty paid to the Franchisor / (Brand).

The Franchisee collects samples and sends them to central laboratory setted up by the Franchisor, The Franchisor generates the medical report and the reports are routed to Patients through Franchisee.


Will there be any service tax on such royalty paid to franchisor and how will that be calculated.

Refund of token amount

I have paid a token amount of 1 Lakh rupees for book a flat .But due to some reason I have cancelled the booking & asking for the refund of token amount.
The builder is ready to refund the amount after 20% deduction.
But no such rule was mentioned on the booking form which I filled at the time of booking.

Still do the builder have any rights for deductions ?

Encroachment to leased property

Sir
Due to the non payment of monthly rent for the leased property, the lessor encroached the demised property and switched off the electricity connection to the equipment installed in the property and caused loss to the lesee.
In this circumstance,whether a complaint can be registered in local police station against lessor and provide a draft letter to the police station.

Iimprovements to a house bought from capital gains account.

Sirs,

2013 August I sold a land property for Rs.90 lakhs which I bought in 1985 for Rs.5000.
Of the Rs.90 lakhs sale realization, the net realization was Rs.87,96,944.00 after deducting the following :

Cost of acquisition with indexation 47,326
Cost of improvement with indexation 65,730
Brokerage for selling the land property 90,000
--------------
Total deduction claimed 2,03,056
Net realization on sale of land property. 87,96,944

I invested in Capital Gain Account before 31.7.2014 the entire amount of Rs.90,00,000/- with Canara Bank, T. Nagar, Chennai.

2014 August I bought a land with house including registration charges for Rs.87,50,000 which I paid out of my CG Account.

In addition, brokerage paid Rs.1,00,000/- to the real estate broker who facilitated the purchase out of my personal account as bank would not pay this from CG account.
Thus total investment was Rs.88,50,000.

The house that I bought required the following improvements to make it habitable (not additional structure, but only improvement to the existing building :

- providing steel protective grills to the doors, balcony, etc.,
- raise the height of the compound wall from 4ft to 5.50’ high.
- build a 2-foot wall to the open well and grill-cover it.
- give a complete painting/white washing, etc.

These cost me around Rs.2,50,000/- but the bank refuses to make payment from my CG Account as according to them improvement expenses cannot form part of the cost of the house purchased.

I was given to understand that cost of improvement/renovating the house is allowed under both Sec 54 and 54F. My bankers say these sections apply only for the construction of a new house and not for the house bought.

I solicit your valuable guidance in this matter so that I can again approach Canara Bank to release payment of the above improvement expenses from my CG Account.
