Moot case

Ms Roma V. Oriental Television Inc

Dotted with a plethora of small hills covered by thick forests, the district of Phoolwadi attracts tourists from distant places. It provides thrilling scenic beauty and being away from the bustle of modern life, is ideal for holidaying. Small lodges and motels have come up; though restful and comfortable, they are very isolated. Some of these dwellings are deep inside the thick forests. The location and the resulting influx of tourists regularly to Phoolwadi have come as a boon to the professional dacoit Kalikaran. The tourists are easy targets for his typical and daring operations. Kalikarna shot into the lime light when he held Ms Roma, who was recently decorated with the 'Charming Bride India' title at a national beauty contest, captive in suite no. 3 of Triveni Cottages. He was holded up in the cottage along with the hostage. The high drama ended in an operation by the National Commandos at the end of seven days which led to the arrest of Kalikaran. One of the Commandos, who was shot at by Kalikaran, succumbed to his injuries. Kalikaran was convicted and sentenced to death. The death sentence was confirmed by Higher Courts and his mercy petition was rejected.

Being alone in the prison and awaiting death, Kalikarana recounted the 'hostage drama'. He wrote a book giving a detailed account of those seven days, Kalikaran also disclosed how Miss. Roma, during the period of captivity, was drawn towards him and developed a 'fatal attraction'.

A leading television channel, Oriental Television Inc. (OTV) approached Kalikaran for his consent to shoot a serial based on the book. Kalikaran agreed to the request and accordingly after his execution, a popular serial titled "The Bride and the Beast" was shot with look alikes. The serial became a hit particularly among the teenagers.

Aggrieved by the public disclosure, Miss Roma filed a suit against OTV claiming compensation and damages.

Can a public ltd company join a political party

Dear Experts

I would like to present one case study of mine friend kindly advice on the same.

1) He is working with 1 Of leading pharma compnay.
2) Companies hidden policy it that " does not allow a person to work for more than 5-7 years."
3) For it companies managment use transfer, demotions and keep on promotioning younger population over older employees.
(4) My friend is working since last 11 years. Within a span of 4 years he became zoanl manager and worked at H.Office level for 2 years.
(5) Further compnay abolished this designation and reassigned him at field in lower position.
(6) Some managers like him left jobs due to transfer, demotions.
(7) But being a family responsibility he decided to stick with the given position.
(8) In last 5 years he demoted as a area manager, transferred trice from Mumbai to navimumbai, Navimumbai to Kolhapur and now Kolhapur to Ratnagiri.
(9)Management kept him giving different divisions during this span of working.
(10) As the peple who were junior and reporting to him now get promoted 2 levels above him.
(11) Because of 11 years experience he has now getting good salary which he will not get in any other pharma company.
(12)Managment as per rules can not halt his salary increament but did not giving him any promotion.
(13)By doing this management pulling his moral down.
(14)The people with detoriated communication, writting skills and less educated getting promotions based on favorism.
(15) His activites are not highliged at Upper level.
(16)Since last 5 years he is fighting with such demoralizing situation which is imposed on him by managment.
(17)At every transfer place he got 1 vilian in management who has halted his growth.
(18) Now he want to join any political party as a part time basis which he feels will improve his mental satisfaction.
(19) He thinks that such joining with political parties will weaken managments stratergies at leat he will be in confident mode with having a positions of District President in a political parties.
(20) He dont think that company will give him further promotin at all.
(21)Being a polite employee he never opposed to tranfer ,demotions and change in departments.
(22) We would like to know does any law prohibit employee to join a political party.

Can i chat as some unknown person to collect evidence?

Hi,

My boyfriend is cheating on me. So to catch him, I created a new gmail id under some unknown girl's name and started chatting with him and he started flirting too. I want to mention that i didnt impersonate or use some other living girl's id. I created a new gmail id with some unknown name and started chatting just to catch my boyfriend red handed when he is cheating me., . Can I use this as evidence? Is it legal to chat in the name of some non-existent girl to collect evidence?

Thanks,

Personal

my friend is asking me to return everything he has gifted me like phone, camera etc and cash amounts at times. i have been avoiding this situation but now i want to return it all but at the same time i need a proof that i have returned him all so that he doesn't bother me in future as i believe he later he would say i never took back anything. moreover i want to make sure that he doesn't contact me or interferes in my life in any way. he has threatened me many times of dire consequences...is there any legal way i can obtain his consent on all this:-

1) he has received back everything all goods including cash and i owe him nothing further
2) he wont contact me or affect my life anyway
3) if he does interfere he will have to face legal action?

please tell me a proper way i can get out this issue.

regards
esha
